Biography: (The Raawi) He was the Maaliki Imaam of North Africa: Abu Sa’eed ‘Abdus Salaam bin Habeeb bin Hasaan bin Hilaal bin Bakkaar bin Rabee’ah bin ‘Abdullah at-Tanookhi, originally Al-Himsi known as Sahnoon (d.240H). He was the Qaadhi of Qayrawan. He heard from Sufyaan bin ‘Uyaynah, Abdur Rahman ibnul Qasim, Al-Waleed bin Muslim, Ibn Wahb, Wakee’ bin Jarrah, and many others. (Siyar A’laam an-Nubalaa 12/64)

Description: 20 Lines/Page |Written on Parchment in Sepia ink | No Diacritic marks, indicating that it is likely from the late 5th or early 6th century. There are some Marginal notes (Hawashi) in the same Sepia ink citing Fadhl from Ahmad bin Sulayman from Sahnoon (verso) – Ahmad bin Sulayman is one of the 7 Ruwaat from Sahnoon in Andalus: Ahmad bin Sulayman bin Abi Rabee’ Al Andalusi (d. 281-290H) . Recto is severly faded, there are some blotches and damage to the corners.

Incipit: طالق إن كان كلم فلانا ثم شك بعد ذلك، فلا يدري أكلمه أم لا، فهذا الذي تطلق عليه امرأته

Explicit: قلت: أرأيت إذا شك الرجل في يمينه فلا يدري بطلاق حلف أم بعتق أم بصدقة

Research Notes: Asad bin Al Furat, the one who conquered Sicily, had traveled to Iraq and learned about the Hanafi Fiqh through one of Imaam Abu Haneefah’s students. He wanted to achieve the same with Imaam Maalik, so he traveled to meet Imaam Malik’s students and he was only satisfied with Imaam ‘Abdur-Rahman Ibn Al-Qaasim Al-‘Utaqi. He copied down the Masaa’il as stated by Ibnul Qaasim, but there were some issues with the answers. Ibnul Furaat’s Asadiyyah reached Sahnoon bin Sa’eed at-Tanookhi who traveled to Egypt and rewrote the book with Ibnul Qaasim- who updated the answers. Sahnoon’s Mudawwanah from the Riwaayah of Ibnul Qaasim became more famous and widespread than Asad bin Al-Furat’s Assadiyyah with the Riwayah of Ibnul Qaasim. |
